Terms of Service

These terms govern your use of the Akwaaba platform — the website at akwaaba.app and the Akwaaba mobile app. Please read them carefully.

Welcome to Akwaaba. These Terms of Service ("Terms") govern your use of the Akwaaba platform, operated by Akwaaba App Labs, Inc., a company incorporated in the State of Delaware, United States, and registered with the Ghana Tourism Authority. By accessing or using the Service, you agree to be bound by these Terms.

Acceptance of Terms

By using Akwaaba, you confirm you're 18+ and legally able to enter contracts.

By creating an account, making a booking, or otherwise using the Service, you confirm that you are at least 18 years of age and legally capable of entering into a binding agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Account Responsibility

Keep your credentials safe. You're responsible for everything under your account.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use at support@akwaaba.app. Akwaaba is not liable for losses arising from unauthorized access to your account.

What Akwaaba Does

We connect travelers with curated Ghana experiences. We're a marketplace, not the experience provider.

Akwaaba provides a travel platform that connects travelers with curated Ghana travel packages, experiences, events, and AI-powered itinerary planning. We act as an authorized agent between travelers and local hosts, experience providers, and service vendors. Hosts are independent operators solely responsible for the experiences, services, and legal compliance of their listings.

Booking Terms

Bookings are confirmed once you receive a confirmation email. Make sure your travel documents are valid.
  • All bookings are subject to availability and confirmation by the host or experience provider.
  • By completing a booking, you agree to the specific terms, inclusions, and exclusions described in the listing.
  • Akwaaba reserves the right to cancel or modify bookings in cases of force majeure, safety concerns, or listing inaccuracies.
  • You are responsible for ensuring you have valid travel documents (passport, visa) for travel to Ghana.
  • A reservation deposit may be required to hold your spot. The $100 deposit is refundable per our cancellation policy.

Payment Terms

Payments are processed securely via Paystack. Ghana users are charged in GHS as required by Bank of Ghana.
  • All payments are processed securely through Paystack. By making a payment, you agree to Paystack's terms of service.
  • Prices displayed to Ghana-based users are in Ghanaian Cedis (GHS) in compliance with Bank of Ghana Notice BG/GOV/SEC/2022/04. International users see prices in their local currency.
  • For curated packages, a $100 refundable reservation deposit is required to hold your spot. The remaining balance is due per the schedule outlined at booking.
  • All applicable taxes (VAT) are included in the displayed price.

Cancellation & Refunds

Experiences: free cancel 48h before. Packages: full refund 30+ days out. Force majeure handled with credits.

Experiences & Events

  • Cancel 48+ hours before: full refund
  • Cancel within 48 hours: non-refundable

Curated Packages

  • Cancel 30+ days before departure: full refund minus $50 admin fee
  • Cancel 15–29 days before: 50% refund
  • Cancel within 14 days: non-refundable
  • $100 reservation deposit is refundable if cancelled within the above windows

Force Majeure

  • Natural disasters, pandemics, government travel restrictions, or other extraordinary circumstances: we will work with you to reschedule or provide credit toward a future booking

Refunds are processed within 7–10 business days to the original payment method.

User Conduct

Use Akwaaba honestly. Don't misuse the platform or harm other users.
  • You agree not to: use the service for any unlawful purpose
  • You agree not to: impersonate another person or entity
  • You agree not to: interfere with or disrupt the service or its infrastructure
  • You agree not to: scrape, harvest, or collect data from the service without consent
  • You agree not to: post false, misleading, or defamatory content
  • You agree not to: circumvent security features or access restrictions
  • You agree not to: attempt to contact hosts or experience providers outside the akwaaba platform to circumvent fees

Hosts & Operators

Hosts are independent operators. Akwaaba acts as their agent — not the seller of their services.

Experience providers, package operators, and event hosts who list on Akwaaba ("Hosts") are independent operators, not employees or agents of Akwaaba. Akwaaba collects payments from customers on behalf of Hosts as an authorized agent and remits proceeds net of the platform fee.

Hosts are solely responsible for their own income taxes, VAT obligations, Ghana Tourism Authority (GTA) licensing, and all other legal requirements applicable to their business. Akwaaba does not withhold or remit taxes on behalf of Hosts.

Intellectual Property

Our content belongs to us. Don't reproduce it without permission.

All content on the Service — including text, images, logos, designs, software, and AI-generated itineraries — is owned by or licensed to Akwaaba App Labs, Inc. and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

Limitation of Liability

We're not liable for consequential damages. Our total liability is capped at what you paid us.

To the maximum extent permitted by law, Akwaaba shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including lost profits, data loss, or travel disruptions.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to Akwaaba in the 12 months preceding the claim.

Disclaimer of Warranties

The platform is provided "as is." Travel inherently involves risk — you take responsibility for your decisions.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. Akwaaba does not guarantee that experiences, packages, or events will meet your specific expectations. Travel inherently involves risks, and you assume responsibility for your travel decisions.

Indemnification

If your actions cause us legal trouble, you cover the costs.

You agree to indemnify and hold harmless Akwaaba, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

Governing Law

Delaware law applies. Disputes are resolved in Delaware courts.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law provisions. Any disputes shall be resolved in the courts located in Delaware, and you consent to the jurisdiction of such courts.

Changes to Terms

We'll notify you of material changes by email or prominent notice. Continued use = acceptance.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance of the revised Terms.
