Waiver & Release

Read carefully before booking. By participating in any Akwaaba travel package, experience, or activity, you agree to the terms below.

Read this carefully. This is a legally binding agreement between you (“Traveler” or “you“) and Akwaaba App Inc. and its affiliates (“Akwaaba“, “we“, or “our“). By booking, paying for, or participating in any Akwaaba travel package, experience, or activity (each a “Travel Service“), you confirm that you have read, understood, and agreed to this Waiver. If you do not agree, do not book or participate.

Akwaaba’s Role & Third-Party Suppliers

Akwaaba is a curator and platform that arranges Travel Services on your behalf with independent third-party suppliers (“Suppliers“), including but not limited to: hotels and lodges, drivers and ground transport providers, tour guides, cultural practitioners, spa and wellness practitioners, hair braiders, nannies and childcare providers, barbers, restaurants and chefs, paragliding and adventure operators, boat and yacht operators, safari operators, festival organizers, photographers, and event venues.

You acknowledge that Suppliers are independent contractors, not employees or agents of Akwaaba. Akwaaba does not own, operate, or directly control the Suppliers’ businesses, vehicles, equipment, premises, or personnel. Akwaaba’s responsibility is limited to reasonable care in the selection and coordination of Suppliers; Akwaaba is not responsible for the acts, omissions, negligence, willful misconduct, or breach by any Supplier. Any claim arising from a Supplier’s services must be pursued directly against that Supplier.

Assumption of Risk

You understand that travel in Ghana, including activities arranged by Akwaaba, involves inherent and unavoidable risks that cannot be eliminated regardless of the care taken. These risks include, without limitation:

  • Adventure activities: paragliding, hiking, mountain trekking (including Afadjato, Wli Falls, Boti Falls), zip-lining, kayaking, paddleboarding, snorkeling, swimming, cliff jumping, quad biking, and similar activities — risks include falls, drowning, equipment failure, exposure, and serious injury or death.
  • Wildlife encounters: safari activities at Mole National Park, Shai Hills, Bui National Park, Wechiau, and Paga Crocodile Pond — risks include attack, bite, trampling, transmission of disease, and unpredictable animal behavior.
  • Water activities: Lake Volta cruises, ocean swimming (Busua, Bojo, Labadi, Ada Foah), boat transfers, and yacht charters — risks include drowning, capsizing, currents, marine life, and weather changes.
  • Ground transport: private vehicle, taxi, ride-share, motorcycle, and domestic flight transport in Ghana — Ghanaian road conditions, driving practices, and traffic differ materially from Western standards. Risks include collision, breakdown, robbery, and delay.
  • Cultural and religious activities: traditional ceremonies, drumming, dance, libation rituals, and shrine visits — risks include physical exertion, exposure to traditional substances, and cultural misunderstanding.
  • Health and medical: exposure to malaria, yellow fever, typhoid, dengue, cholera, traveler’s diarrhea, foodborne illness, dehydration, sun exposure, allergic reaction, and other tropical or environmental health risks.
  • Crime and security: petty theft, scams, civil unrest, and crime against tourists.
  • Force majeure: weather events, natural disasters, political instability, government action, strikes, pandemics, and acts beyond anyone’s control.

You voluntarily assume all such risks, both known and unknown, and accept full personal responsibility for any injury, illness, death, property damage, or loss arising from your participation in any Travel Service.

Release of Claims

To the fullest extent permitted by law, you hereby release, waive, discharge, and covenant not to sue Akwaaba App Inc., its parent, subsidiaries, affiliates, officers, directors, employees, agents, hosts, contractors, and successors (collectively, “Released Parties“) from any and all claims, demands, damages, losses, costs, expenses (including attorneys’ fees), and causes of action of any kind, whether known or unknown, arising from or related to:

  • Personal injury, illness, disability, or death suffered by you or any minor child you accompany;
  • Loss, damage, or theft of personal property;
  • Acts, omissions, or negligence of any Supplier or third party;
  • Force majeure events or circumstances beyond Akwaaba’s reasonable control;
  • Any consequence of your participation in any Travel Service.

This release applies whether the claim is based on negligence, breach of contract, breach of warranty, strict liability, or any other legal theory.

This release does not apply to claims arising from Akwaaba’s gross negligence or willful misconduct, or to any rights that cannot be waived under applicable law.

Health, Fitness & Medical Disclosure

You represent and warrant that:

  • You are physically and mentally fit to participate in the Travel Services you have booked;
  • You have disclosed to Akwaaba (in writing, prior to travel) any medical condition, allergy, mobility limitation, mental health condition, pregnancy, or medication regimen that could affect your participation or require special accommodation;
  • You have consulted a qualified physician about travel to Ghana, including required and recommended vaccinations (including yellow fever, which is mandatory for entry), antimalarial medication, and any precautions related to your medical history;
  • You will follow all guide and operator safety instructions during the trip;
  • You will not participate in any activity if you reasonably believe you cannot do so safely.

Failure to disclose a material medical condition releases Akwaaba from any liability arising from that condition.

Mandatory Travel Insurance

Akwaaba requires all travelers to carry valid travel insurance for the full duration of their Travel Service that covers, at minimum:

  • Medical treatment and hospitalization (minimum US$100,000 coverage);
  • Emergency medical evacuation and repatriation (minimum US$250,000 coverage);
  • Trip cancellation, interruption, and delay;
  • Lost or stolen baggage and personal effects.

Akwaaba bookings include SanlamAllianz Ghana base coverage where indicated, but you are responsible for confirming that coverage meets your needs and for purchasing supplemental insurance if it does not. Akwaaba is not your insurer and is not responsible for any costs that should have been covered by insurance you failed to obtain.

Emergency Medical & Evacuation Costs

You are solely and personally responsible for the cost of any medical treatment, ambulance service, hospitalization, medical evacuation, repatriation of remains, or related expenses incurred during or as a result of your Travel Service, regardless of cause.

You authorize Akwaaba and its Suppliers, in the event of a medical emergency where you are unable to consent, to arrange emergency medical care, transport, and evacuation on your behalf. You agree that any costs advanced by Akwaaba or a Supplier on your behalf are your debt to be reimbursed promptly, plus a 5% administrative fee.

Minors & Parental Responsibility

If you are traveling with a minor child (anyone under 18), you represent and warrant that you are the parent or legal guardian of that child, or that you have written authorization from the parent or legal guardian to make travel decisions on the child’s behalf.

You agree to:

  • Supervise the minor at all times, including when nanny, childcare, or babysitting services are provided as part of an Akwaaba package;
  • Make all medical and emergency decisions for the minor;
  • Indemnify and hold harmless the Released Parties for any injury, illness, or claim involving the minor;
  • Sign any additional minor-specific waiver required by an activity Supplier (e.g., paragliding, water sports).

For Akwaaba packages that include nanny or childcare services (including but not limited to Family Villa Ghana): the nanny is an independent Supplier and not an employee of Akwaaba. Akwaaba is not liable for the acts or omissions of nanny Suppliers. You remain ultimately responsible for the safety of the minor.

Alcohol, Cannabis & Controlled Substances

You acknowledge that Akwaaba packages may include alcohol service, nightlife venues, and social events where alcohol is consumed. You agree:

  • To consume alcohol responsibly and only if you are of legal drinking age in Ghana (18) and your home country;
  • That participation in any activity while impaired by alcohol or any controlled substance is at your sole risk and waives any claim against Released Parties;
  • That cannabis and most controlled substances are illegal in Ghana, and Akwaaba is not responsible for any legal consequences if you possess, purchase, or use them;
  • That Akwaaba and its Suppliers may, at their sole discretion, refuse service or remove you from any activity if your conduct (intoxicated or otherwise) creates a risk to yourself, other travelers, or Suppliers — without refund.

Photography & Media Release

You grant Akwaaba a non-exclusive, royalty-free, worldwide license to use photographs, video, and audio recordings in which you appear (whether captured by Akwaaba, its Suppliers, or other travelers) for marketing, social media, editorial, and promotional purposes. If you do not consent, you must notify Akwaaba in writing prior to your trip and inform any photographer onsite.

Cancellation & Refund Policy

Cancellation and refund terms for each booked Travel Service are set out in the booking confirmation and the package-specific terms. In summary:

  • 60+ days before departure: Full refund minus 10% administrative fee.
  • 30–59 days before departure: 50% refund.
  • Less than 30 days before departure: No refund. Trip credit may be issued at Akwaaba’s discretion.
  • No-show or partial completion: No refund.
  • Force majeure (per Section 2): Akwaaba will issue trip credit equal to the unused portion. Cash refunds are not available for force majeure.

Trip insurance is the only reliable protection against cancellation losses. You acknowledge that your decision to purchase or not purchase trip insurance is your own.

Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any claim, demand, loss, or expense (including reasonable attorneys’ fees) arising from: (a) your acts or omissions; (b) your violation of this Waiver, the Akwaaba Terms of Use, or any applicable law; (c) injury or harm caused by you to any third party; (d) your participation in any activity in violation of safety instructions; or (e) any claim by a minor child you accompany.

Governing Law & Dispute Resolution

This Waiver is governed by the laws of the State of New York, USA, without regard to conflict-of-laws principles. Any dispute arising from this Waiver or any Travel Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, conducted in New York County, NY.

You waive any right to a jury trial and to participate in any class action. For Travelers domiciled in the European Union or United Kingdom, mandatory consumer protections under your local law continue to apply notwithstanding this section.

Severability & Survival

If any provision of this Waiver is found unenforceable, the remaining provisions remain in full force. The provisions of Sections 2 (Assumption of Risk), 3 (Release), 6 (Evacuation Costs), 7 (Minors), and 11 (Indemnification) survive completion or termination of any Travel Service.

Section 14  ·  Acknowledgment

By booking, paying for, or participating in an Akwaaba Travel Service, you confirm that:

  • You have read this entire Waiver;
  • You understand its terms;
  • You are at least 18 years old, or are signing on behalf of a minor as their parent or legal guardian;
  • You voluntarily and knowingly accept the risks described herein;
  • You release the Released Parties as described herein;
  • This Waiver is binding on you, your heirs, your estate, your spouse, and any minor child you accompany.
