These Terms of Use are a legally binding contract between you and Akwaaba App. By using the Akwaaba platform — including our websites, mobile apps, and all related services — you agree to be bound by these terms.
Akwaaba App Consumer Services Terms of Use
These Terms of Use cover your use of the Akwaaba App consumer services (the “Services”), which consist of:
- Our websites: AkwaabaApp.app and Akwaaba.app, and any other consumer websites offered by Akwaaba App (the “Sites”)
- The mobile apps: Akwaaba App
- The services, features, content and widgets offered by Akwaaba App in connection with the above
These Terms of Use do not cover our enterprise (business) websites or services. Those services are described in our Enterprise Site Terms.
Acceptance of Terms
By registering for and/or using the Services in any manner, including but not limited to visiting or browsing the Site(s), you agree to all of the terms and conditions contained herein (“Terms of Use”), which also incorporate:
- Akwaaba App’s Privacy Policy
- Akwaaba App’s Intellectual Property Policy
- Akwaaba App’s Photo Guidelines
- Akwaaba App’s Venue Terms and Conditions
- Placed Points Program
- All other operating rules, policies and procedures published from time to time on the Site(s)
These Terms of Use apply to all users of the Services, including contributors of content, information, and other materials, individual users, venues, and users that have a page on the Services.
Access
Subject to these Terms of Use, Akwaaba App may offer to provide the Services, as described more fully on our Sites, selected by you solely for your own use, and not for the use or benefit of any third party. Services shall include, but not be limited to, any services Akwaaba App performs for you, any applications or widgets offered by Akwaaba App that you download from our Sites or from third party application stores authorized by Akwaaba App (e.g., the iTunes® store or Google Apps Marketplace), as well as the offering of any materials displayed or performed on or through the Services.
Registration and Eligibility
You may need to register for an account or use credentials from a third party social media platform to access some or all of our Services. If you register, you shall provide Akwaaba App with accurate and complete registration information. You will keep your registration information accurate and up-to-date. Failure to do so shall constitute a breach of these Terms of Use.
You agree that you will not:
- Create an account for anyone other than yourself without that person’s permission
- Create a username that is the name of another person with the intent to impersonate that person
- Create a user name or Akwaaba App account subject to rights of another person without appropriate authorization
- Create a user name that is offensive, vulgar, obscene or otherwise unlawful
You must be at least 13 years of age to access or use the Services. If you are under 18, you may only access or use the Services under the supervision of a parent or legal guardian who agrees to be bound by these Terms of Use.
You are solely responsible and liable for activity that occurs on your account. You shall never use another user’s account without prior express permission. Notify Akwaaba App immediately of any unauthorized use of your account.
Privacy
By using the Services, you consent to Akwaaba App’s collection, use, and disclosure of information about you and your device. Please refer to our Privacy Policy for information about how we collect, use and disclose information about you.
House Rules
Good things
Akwaaba App is a community platform built on trust and mutual respect. We ask that you:
- Be honest and accurate in your reviews and information
- Respect other users, venues, and hosts
- Use the platform to share genuine experiences of Ghana
- Report any content that violates these terms
Not cool
The following behaviors are prohibited on the Akwaaba platform:
- Posting false, misleading, or defamatory content
- Harassment, abuse, or threatening behavior toward any user
- Spam, commercial solicitation, or unsolicited advertising
- Impersonating any person or entity
- Uploading content that infringes third party intellectual property rights
- Attempting to gain unauthorized access to any part of the Services
- Using automated tools to scrape or collect data from the Services
- Any activity that violates applicable law or regulation
Indemnification
You agree to defend, indemnify, and hold harmless Akwaaba App, its subsidiaries, affiliates, officers, directors, employees, agents, partners, and licensors from and against any claims, actions or demands, including without limitation reasonable legal and accounting fees, alleging or resulting from your use of the Services, your Content, or your violation of these Terms of Use.
Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Akwaaba App, its affiliates, officers, directors, employees, agents, suppliers, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the Services
- Any conduct or content of any third party on the Services
- Any content obtained from the Services
- Unauthorized access, use, or alteration of your transmissions or content
Whether based on warranty, contract, tort (including negligence), or any other legal theory, and whether or not Akwaaba App has been informed of the possibility of such damage.
Governing Law
These Terms of Use shall be governed by and construed in accordance with applicable law. Any disputes arising under these Terms of Use shall be subject to the jurisdiction specified in our arbitration provisions. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Legal Compliance
You represent and warrant that you are not located in a country that is subject to a U.S. government embargo or that has been designated by the U.S. government as a “terrorist supporting” country, and that you are not listed on any U.S. government list of prohibited or restricted parties.
Government Use
If you are a U.S. Government end user, Akwaaba App is providing the Services to you as a “Commercial Item” as defined under 48 C.F.R. §2.101, and the rights provided to you will not exceed the rights provided to non-governmental customers.
Apple Terms of Service
If you are using the Akwaaba App mobile application on an Apple iOS device, you acknowledge that these Terms are between you and Akwaaba App only, and that Apple has no responsibility for the application or its content. Apple is a third-party beneficiary of these Terms with respect to the iOS application.
Modification of Terms
Akwaaba App reserves the right to modify these Terms of Use at any time. We will notify you of material changes by posting the new Terms of Use on the Sites and updating the “Last updated” date. Your continued use of the Services after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to the new Terms of Use, you must stop using the Services.
Integration and Severability
These Terms of Use are the entire agreement between you and Akwaaba App with respect to the Services and supersede all prior or contemporaneous communications and proposals. If any provision of these Terms of Use is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms of Use will otherwise remain in full force and effect.
Language
These Terms of Use are drafted in the English language. Any translation provided is for convenience only. In the event of any conflict between the English version and any translation, the English version shall prevail.
Cancellation & Termination
You may cancel your account at any time by contacting us at [email protected] or through the account settings in the Akwaaba App.
Akwaaba App reserves the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice. Upon termination, all provisions of these Terms of Use that by their nature should survive termination shall survive.
Unsolicited Idea Submission Policy
Akwaaba App does not accept or consider unsolicited ideas, including but not limited to ideas for new products, technologies, services, marketing plans, or other business concepts. Please do not send any original creative artwork, samples, demos, or other works to Akwaaba App. The purpose of this policy is to avoid potential misunderstandings or disputes when Akwaaba App’s products or marketing strategies might seem similar to ideas submitted to us.
Miscellaneous
The failure of either party to exercise in any respect any right provided for herein shall not be deemed a waiver of any further rights hereunder. Akwaaba App shall not be liable for any failure to perform its obligations hereunder where such failure results from any cause beyond Akwaaba App’s reasonable control.
Trademark & Brand Guidelines
The Akwaaba App name, logos, and brand marks are protected trademarks. Akwaaba App must protect its marks to preserve their distinctiveness and the trust they represent to our community.
General Guidelines
- Do not use Akwaaba App marks in a way that suggests affiliation with or endorsement by Akwaaba App without our express written consent
- Do not alter, modify, or create derivative works of Akwaaba App marks
- Do not use Akwaaba App marks as part of your own brand name, product name, or service name
- Always include appropriate trademark notices when using Akwaaba App marks
- Use marks in their exact form — do not abbreviate, hyphenate, or modify them
Specific Guidelines
Powered by Akwaaba App logo license: Partners who have received express written permission to display a “Powered by Akwaaba App” badge must follow the current brand guidelines provided by Akwaaba App at the time of licensing.
Approved Terms license: Any approved use of Akwaaba App’s name or marks must reference Akwaaba App as the source and include the ® or ™ symbol as appropriate.
Copyright Policy
Akwaaba App respects the intellectual property rights of others and expects users of the Services to do the same. Akwaaba App will respond to notices of alleged copyright infringement that comply with applicable law.
Reporting Copyright Infringement
If you believe that content on the Akwaaba App platform infringes your copyright, please send a notice to our designated agent with the following information:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
- Identification of the copyrighted work claimed to have been infringed
- Identification of the material that is claimed to be infringing and where it is located on the Services
- Your contact information (address, telephone number, and email address)
- A statement that you have a good faith belief that the use is not authorized by the copyright owner
- A statement that the information in the notification is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on their behalf
Reporting Trademark Infringement
To report trademark infringement, please contact us at [email protected] with the details of the mark being infringed and the location of the infringing content on our platform.
Counter-Notice Procedure
If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to our designated agent. Your counter-notice must include your contact information, identification of the removed content, a statement under penalty of perjury that you have a good faith belief the content was removed by mistake, and your consent to the jurisdiction of the relevant courts.
